1. Acceptance

By creating an account or using Swarmcast (the "Service") you agree to these Terms, our Community Guidelines, Privacy Policy, and Copyright Policy. If you do not agree, do not use the Service. If you use the Service on behalf of an organization, you confirm you are authorized to bind it.

2. Eligibility and age

You must be at least 13 years old (or the minimum digital-consent age in your country, if higher) to use the Service. The Service is not directed to children under that age, and we do not knowingly collect their data. If we learn an account belongs to an underage user, we will remove it.

3. Your account

You are responsible for your account, your credentials, and all activity under it. Keep your password secure and notify us promptly of any unauthorized use. We may refuse, suspend, or terminate accounts that violate these Terms.

4. Your content

You keep ownership of the content you upload ("Your Content"). By uploading, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, encrypt, distribute across the peer-to-peer network, transcode, cache, and display Your Content solely to operate and provide the Service. This licence ends when you delete the content or your account, except for copies already cached on independent network nodes, which age out over time, and copies we must retain for legal reasons.

You represent and warrant, each time you upload, that:

5. Prohibited content and conduct

You may not upload, share, or do anything described in our Community Guidelines, including (without limitation): content that sexualizes minors; sexually explicit / pornographic content (which is not permitted on the Service); incitement to violence or terrorism; content that infringes copyright; malware or deceptive content; or harassment of others. We may remove content and act on accounts that breach these rules.

6. The peer-to-peer network

Swarmcast distributes encrypted content chunks across participant-operated nodes. If you operate a node, you additionally agree to the node operator terms presented at setup. Node participation, capacity, and any token-based rewards are governed by the published Economy rules and may change.

7. Moderation, removal, and appeals

We review uploads and reports and may remove content or restrict accounts that violate our rules. Where we remove your content or restrict your account, we will, where feasible and lawful, tell you the reason and offer an appeal. We may act immediately, without prior notice, where content is illegal or poses a safety risk.

8. Intellectual property of the Service

The Service software, design, and trademarks are owned by [[LEGAL ENTITY NAME]] or its licensors. These Terms grant you no rights in them beyond using the Service as intended.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, to the fullest extent permitted by law. We do not guarantee that content is accurate, that the Service is uninterrupted, or that distributed copies are always available.

10. Limitation of liability

To the fullest extent permitted by law, [[LEGAL ENTITY NAME]] will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. 12. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access for breach of these Terms or where required by law. Sections that by their nature should survive termination (e.g. ownership, disclaimers, liability) will survive.

13. Changes

We may update these Terms. We will post the new version with a new effective date and, for material changes, ask you to re-accept. Continued use after changes take effect means you accept them.
